Customers Acknowledgement of Risks, Assumption of Risk and Responsibility, and Release of Liability
WARNING: There are significant elements of risk in any adventure sport or activity associated with the outdoors or wilderness, including but not limited to kayaking, boating, camping, biking/climbing/hiking/trekking, fishing, and the use of any related equipment (all referred to herein as “activity and or activities”).
ACKNOWLEDGEMENT OF RISKS: I recognize that there are inherent risks involved with participation in a guided or unguided outdoor activity and or activities.
Inherent Risks: It is imperative that you as a participant, volunteer, instructor, vendor, or provider, that you know, understand and accept that this activity encompasses and includes inherent risks and dangers due to the nature of the sport and its settings. that the programs and activities of outdoor adventure tours, including wildlife viewing, beach walks, boating can be dangerous, exposing participants to many inherent risks and hazards, including but not limited to: loss or damage to personal property, immersion in cold water, hypothermia, drowning, inclement weather, slipping and falling, falling objects, or suffering any type of accident or illness in remote areas without easy access to medical facilities. While some of these risks are inherent in the very nature of the activity and activities, other may result from mechanical failure and human error and negligence on the part of persons involved in preparing, organizing and staging the activity or activities;
a.
that, as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, including but not limited to nausea, broken bones, cuts, bruises, burns, back and neck injuries, even death, as well as property loss;
that, as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, including but not limited to nausea, broken bones, cuts, bruises, burns, back and neck injuries, even death, as well as property loss; b.that I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my participation in the aforesaid activity and activities will be entirely at my own risk;

that I am responsible for and will bear all costs or expense of rescue or medical attention rendered to me or for my benefit while preparing for, traveling to or from or participating in any Adventure Sixty North LLC activity or activities; e.that I understand clearly by signing this release, I will be forever prevented from suing or otherwise claiming against Adventure Sixty North LLC, its officers, directors, employees, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in, traveling to or from, or preparing for any of the above mentioned activity or activities, whether or not such loss or injury is caused solely or partly by the negligence of the company or any of its officers, directors, employees, independent contractors and agents;
that I understand clearly by signing this release, I will be forever prevented from suing or otherwise claiming against Adventure Sixty North LLC, its officers, directors, employees, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in, traveling to or from, or preparing for any of the above mentioned activity or activities, whether or not such loss or injury is caused solely or partly by the negligence of the company or any of its officers, directors, employees, independent contractors and agents; f.That this RELEASE FROM LIABILITY AND ASSUMPTION OF RISK AGREEMENT is binding upon my heirs, and my executors, administrators, personal representatives, assigns and myself.
That this RELEASE FROM LIABILITY AND ASSUMPTION OF RISK AGREEMENT is binding upon my heirs, and my executors, administrators, personal representatives, assigns and myself. g.All participants will be required to sign a formalized RELEASE FROM LIABILITY AND ASSUMPTION OF RISK AGREEMENT that is binding on their heirs, and executors, administrators, personal representatives, and assigns before participation in any activity conducted by ADVENTURE SIXTY NORTH LLC, officers, directors, employees, independent contractors and agents;
All participants will be required to sign a formalized RELEASE FROM LIABILITY AND ASSUMPTION OF RISK AGREEMENT that is binding on their heirs, and executors, administrators, personal representatives, and assigns before participation in any activity conducted by ADVENTURE SIXTY NORTH LLC, officers, directors, employees, independent contractors and agents; I acknowledge that certain foreseeable and unforeseeable events can contribute to the unpredictability of the activity; that no warranty of any kind, express or implied, is made as to the habits, disposition, suitability, nature or physical condition of any animal; that personal property may be damaged or lost; and that I should ask about other potential hazards and recommended precautions and procedures. I accept that wearing a Coast Guard Type III approved personal floatation device is a basic safety precaution; and that I may suffer accidents or illnesses or death in remote places where there are no available medical facilities.

EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY: In recognition of the inherent risks of the activity which I and any minor children for which I am responsible, will engage in, I confirm that I am/we are physically and mentally capable of participating in the activity and/or using equipment. I/We participate willingly and voluntarily. I assume full responsibility for personal injury, accidents or illness (including death), and any resultant expenses. I also assume responsibility for damage to or loss of my personal property as a result of any accident that may occur. I also have explained the inherent risks to the minor (‘s) and he/she/they are fully informed and understand the inherent risks in participating in this activity and activities.
I assume the risk(s) of personal injury, accidents and/or illness, including but not limited to sprains/strains, torn muscles and/or ligaments; fractured or broken bones; eye damage; cuts, wounds, scrapes, abrasions, and/or contusions; dehydration, oxygen shortage (anoxia), and/or exposure; head, neck, and/or spinal injuries; animal or insect bite or attack; injury caused by discharge or any weapon; shock, paralysis, drowning, and/or death; and acknowledge that during the activity, if I/we experience fatigue, chill or dizziness, it may diminish my/our reaction time and increase the risk of an accident.

COVENANT OF GOOD FAITH: I recognize that you, as a provider of goods and/or services, will operate under a covenant of good faith and fair dealing, but you may find it necessary to terminate an activity due to forces of nature, medical necessities or other problems; and/or refuse or terminate, the participation of any person you judge to be incapable of meeting the rigors or requirements of participating in the activity. I accept your right to take such actions for the safety of myself and/or other participants. I acknowledge that no guarantees (expressed or implied) have been made with respect to achieving objectives.

AUTHORIZATION: I hereby authorize any medical treatment deemed necessary in the event of any injury while participating in the activity. I either have appropriate insurance or, in its absence, agree to pay all costs of rescue and/or medical services as may be incurred on my/our behalf. I agree that any film or photographs of me/us as participants become your property and may be used for promotional or commercial purposes.

RELEASE: In consideration of services or property provided, for myself and any minor children for which I am parent, legal guardian, or who I am otherwise responsible, any heirs, personal representatives, or assigns, do hereby release: Adventure Sixty North LLC, its principals, directors, officers, agents, employees, and volunteers, and each and every land owner, municipal and/or governmental agency upon whose property an activity is conducted, from all liability and waive any claim for damage arising from any cause whatsoever.

I HAVE READ AND UNDERSTOOD THE FOREGOING ACKNOWLEDGEMENT OF RISKS, ASSUMPTION OF RISK AND RESPONSIBILITY, AND RELEASE OF LIABILITY. I UNDERSTAND THAT BY SIGNING THIS, I AM AGREEING NOT TO SUE. I WAIVE ALL CLAIMS, WHATEVER THE CAUSE, INVOLVING ADVENTURE SIXTY NORTH AND OR ITS EMPLOYEES OR REPRESENTATIVES.
Note! Parents must inform their minor children of the forgoing acknowledgement of risks, assumption of risk and responsibility, and release of liability before signing the guardian’s signature line on this legal document!
